Terms and Conditions of Sale

1. Introduction

These Terms and Conditions ("Terms") govern the purchase of the Australia AI Business Index 2026 ("AIBI Report") and related services from WA AI Hub ("we", "us", or "our"), ABN [to be inserted], operating from Western Australia.

By purchasing our products or services, you ("Customer", "you", or "your") agree to be bound by these Terms. Please read them carefully before making a purchase. These Terms are subject to Australian Consumer Law.

2. Australian Consumer Law Statement

Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). For major failures with the service, you are entitled to:

  • Cancel your service contract with us; and
  • Obtain a refund for the unused portion, or compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified within a reasonable time.

3. Products and Services

3.1 AIBI Report Licences

We offer the following licence tiers for the AIBI Report:

  • Single-user Licence ($495 + GST): Full 100+ page report for personal use by one named individual
  • Enterprise Licence ($2,495 + GST): Full report with internal distribution rights within one legal entity
  • Board Briefing (Custom Pricing): Enterprise licence plus 60-minute tailored virtual briefing for Board/Executive Committee

3.2 Executive Summary

We offer a free Executive Summary available for download upon registration. This is provided at no cost and is subject to our Terms of Use.

3.3 Product Description

We endeavour to describe our products accurately. The AIBI Report includes:

  • Comprehensive analysis across seven AI readiness dimensions
  • Jurisdictional scores for all 8 Australian states and territories
  • ADM compliance mapping and readiness assessment
  • Infrastructure gap analysis and energy resilience indicators
  • Digital PDF format (non-editable)

4. Pricing and Payment

4.1 Prices

All prices are displayed in Australian Dollars (AUD). Prices are exclusive of GST unless otherwise stated. GST of 10% applies to all purchases within Australia.

Launch pricing is valid until 30 April 2026. We reserve the right to change prices at any time, but price changes will not affect orders already confirmed.

4.2 Payment Methods

We accept payment via:

  • Credit card (Visa, Mastercard, American Express)
  • Bank transfer (for Enterprise and Board Briefing orders)

4.3 Invoice and Tax Receipt

A tax invoice will be provided electronically upon successful payment. This invoice will include our ABN, the GST amount, and all details required for a valid tax invoice under Australian tax law.

5. Order Process and Delivery

5.1 Order Confirmation

Once your payment is processed, you will receive an email confirmation with:

  • Order reference number
  • Tax invoice
  • Download link or delivery instructions
  • Licence terms applicable to your purchase

5.2 Digital Delivery

The AIBI Report is delivered digitally via secure download link sent to your registered email address. Delivery is typically immediate upon payment confirmation, but may take up to 24 hours during high-demand periods.

5.3 Board Briefing Scheduling

For Board Briefing purchases, our team will contact you within 3 business days to schedule your 60-minute virtual briefing session at a mutually convenient time.

6. Licence Terms

6.1 Single-user Licence

The Single-user Licence grants you the right to:

  • View, download, and store the AIBI Report for personal use
  • Print one (1) copy for personal reference
  • Quote brief excerpts (up to 100 words) with proper attribution

You may not share, distribute, or provide access to the report to any other person.

6.2 Enterprise Licence

The Enterprise Licence grants you the right to:

  • All rights included in the Single-user Licence
  • Distribute the report internally within one legal entity
  • Create internal presentations using report content with attribution
  • Share with Board members, executives, and employees

You may not share the report with external parties, clients, or subsidiaries without a separate licence agreement.

7. Refund Policy

For detailed information about our refund policy, please see our Refund Policy. Key points include:

  • Digital Products: Due to the digital nature of our products, refunds are generally not available once the download link has been accessed
  • Consumer Guarantees: This does not affect your rights under Australian Consumer Law for products that fail to meet consumer guarantees
  • Technical Issues: If you experience technical issues accessing your purchase, contact us for assistance before requesting a refund

8. Intellectual Property

All intellectual property rights in the AIBI Report and related materials remain with WA AI Hub. Your purchase grants you a licence to use the materials as specified in your licence tier, not ownership of the intellectual property.

Unauthorised reproduction, distribution, or commercial use of the AIBI Report may result in legal action and termination of your licence.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The AIBI Report is provided for general informational purposes and does not constitute professional advice
  • We are not liable for any business decisions made based on the report content
  • Our total liability for any claim shall not exceed the purchase price you paid

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Australian Consumer Law.

10. Dispute Resolution

If you have a dispute regarding your purchase:

  1. Contact Us First: Use our contact form with details of your concern. We aim to respond within 2 business days.
  2. Internal Review: If not resolved, request an internal review by a senior team member within 10 business days.
  3. External Mediation: If still unresolved, parties agree to attempt mediation through the Small Business Commissioner of Western Australia or an agreed mediator before legal proceedings.
  4. Consumer Protection: You may also contact Consumer Protection WA (Department of Mines, Industry Regulation and Safety) at www.commerce.wa.gov.au/consumer-protection

11. Privacy

We collect and handle your personal information in accordance with our Privacy Policy and the Australian Privacy Act 1988. By making a purchase, you consent to our collection and use of your information as described in that policy.

12. Governing Law

These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. The courts of Western Australia have exclusive jurisdiction to settle any dispute arising from or in connection with these Terms.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Changes do not apply retroactively to purchases made before the change.
